The Law Office of Keith Short recently settled a medical malpractice case for a client whose arm was injured during a blood draw. The injury caused permanent damage to the nerves running from the client’s elbow to his hand. The hospital claimed acknowledged that the blood draw caused the injury, but claimed that the “accident” was a known risk of the procedure. The problem wasn’t that the accident was a known risk; the problem was that the hospital failed to recognize the injury and treat it in time. We bet they won’t make that mistake again.
