Our client, the plaintiff, was riding his bicycle through a small town when he was struck by a pickup truck driven by the defendant. The plaintiff’s leg was shattered requiring surgery with pins. The defendant claimed the cyclist ran a stop sign…the plaintiff said the truck ran the stop sign. After depositions of witnesses, the insurance company hired an “accident reconstruction expert” to try to prove our client was at fault. Our cross-examination of the expert went so well that the judge threw the expert’s testimony out granting our motion to bar him from testify. After that, the insurance company decided it was best to settle the case.
